Third Party: Charles Greville of the parish of St George, Hanover Square, Middlesex, Esq.
Fourth Party: William, Duke of Devonshire, KG; and Lord William Cavendish Bentinck.
Covenant by (3) to assign to (4) the one fifth share of (2) in the sum of £30000 payable upon the death of (1). Covenant by (1) with (4) to pay an annuity of £300 in trust for (2). Arrangements for the securing or payment of the sums of £4000 and £10000 by (1) to (4) and for dealing with any additional portion of the £30000 to which (2) may become entitled.
Upon trust to apply the income arising from the several sums adding up to £20000 and the annuity of £300 to (2) during the joint lives of (2) and (3), or otherwise as (2) shall direct; thence to pay the same to the survivor of (2) and (3) for life; thence to pay the capital to the issue of (2) and (3) in such manner as (2) and (3) shall jointly direct, with provisions in default thereof; and in default or failure of such issue, then to dispose of the sum of £10000 in such manner as Dorothy, Duchess of Portland shall direct, and failing that to the three younger sons of the said Duke and Duchess of Portland, and to dispose of the sums of £6000 and £4000 as (2) shall direct (if she has survived her husband) but otherwise, upon the death of (3) to the three younger sons of the said Duke and Duchess of Portland.
Recites the provision to be made for (2) by Dorothy, Duchess of Portland from her interest under the will of her brother Lord Richard Cavendish (Pl F7/5/1) and the trust deed of 9 Jan. 1783 (Pl F5/7/33) settling the Manor of Marylebone with provision for charging it with portions etc. for the children of the 3rd Duke of Portland. Recites the lease (Pl F4/4/1) and release by way of mortgage of estates in Marylebone by (1) to (4) to secure £4000 and interest upon trust for (2).
Endorsed deed poll assignment by (3) to (4) of his contingent interest in £6000 upon the trusts of the settlement. |
