Content DescriptionRecitals: (a) act of parliament entitled ' An Act to render more effectual the Agreements that have been made between Thomas Holles [1st] Duke of Newcastle [under Lyne], Henry Pelham, Esquire, Edward Lord Harley, and the Lady Henrietta his Wife, William Vane and Gilbert Vane, Esquires, Sons of Christopher Lord Barnard, or any of them, in Relation to the Will and Estate of John late Duke of Newcastle, and for settling the same in such Manner as may be agreeable to the Intent of the said Agreements, and for other Purposes therein mentioned' dated 5 George I [1718-1719]; (b) common recovery of 7 parts enrolled in Chancery dated 17 Nov. 1741 of land in Mansfield and Mansfield Woodhouse.

(c) surrender and admittance of 4 parts dated 12 Nov. 1764 in order to issue a writ of right close according to the custom of the manor, and for a common recovery to be suffered under the limitations of the act of parliament recited at (a) above; (d) indenture of 4 parts dated 2 Aug. 1737 conveying various lands in Nottinghamshire in trust, as directed by the will of Henrietta Cavendish Holles dated 9 Jun. 1754; (e) fact that the [1st] Duke of Newcastle under Lyne has no issue; Henry Pelham died without issue; and Katherine, Countess of Lincoln died leaving 3 sons all under the age of 15; (f) fact that William Henry Cavendish, Duke of Portland has no issue and is unmarried.

(g) agreement to exact an exchange of their respective estates between Thomas Holles, Duke of Newcastle and Margaret Cavendish, Duchess Dowager of Portland, and notes that some of the Newcastle land is limited by previously recited indentures.

Enacts that the exchange of their respective estates is to be made between the [1st] Duke of Newcastle under Lyne and Margaret Cavendish; fact that the lands and hereditaments of Margaret are to be vested in George Mason and John Rayner, and to be indemnified against all uses and limitations as set out in the indenture recited at (d) above; Mason and Rayner to stand seized of the following property: 82 acres of Normanton Grange lying next to Clumber Park in the parish of Elksley [Elkesley] to the use of the 1st Duke of Newcastle under Lyne.

Further enacts that all the freehold and copyhold farms, lands, tenements and hereditaments in Mansfield, Mansfield Woodhouse, Worksop and Carburton [all in Nottinghamshire], given in exchange by the [1st] Duke of Newcastle under Lyne, [names of tenants provided], are to be vested in Robert Harley and James West, and to be indemnified against all uses and limitations as set out in the indenture recited at (c) above; Harley and West to stand seized of the property previously mentioned to the use of Margaret Cavendish.
