In consideration of various sums of money described in detail below, but amounting to the total of £7120.1.8., assignment from (1) and (2) to (3) of all the property recited at (a) below in Walkeringham, Nottinghamshire; property is to be held for the residue of the term of 99 years as stated in the will of Sir Thomas Williamson [see Ne D 4138]; declaration that Anthony Guidott and Robert Chappell shall stand possessed of the residue of the term of 10,000 years in trust for (3) during the remainder of the 99 years term; after the expiration of that term, they shall stand possessed of the same during the remainder of the term in trust to attend the inheritance; further declared that Henry, Lord [1st Baron] Herbert and Sir Thomas Pelham shall be seized of the fee simple and inheritance of the property in trust for (3) for the residue of the 99 year term; includes usual covenants.
Consideration: £7120.1.8.
Considerations are as follows: £39.39.11.8. paid by (3) to John Hoskins to disharge the debt owing on the mortgage; £964.11.5. paid by (3) for the discharging of the several debts of Sir Thomas Williamson as listed in the attached schedule; £500. paid by (3) to (1) to discharge the same sum devised to him by Jane Williamson; £1500. being the remainder of the sum of £2000. devised in trust and paid to Chancery by (3); £70.14.0. paid by (3) to (1) for the discharging of the other legacies and for the purchase of mourning rings, as provided for in the will of Sir Thomas; £165.4.1. paid to (1) for his own use; these several considerations amount to the total of £7120.1.8. intended for the full and absolute purchase of all the property in Walkeringham.
Includes a schedule of the monies due to the creditors of Sir Thomas Williamson mentioned in the schedule attached to his will; lists individuals by name and the amount owed.
Recitals: (a) details of an indenture dated 31 May 1670 regarding property in Walkeringham; (b) details of a lease and release dated 24-25 Mar. 1698 [see Ne D 4134-4136]; (c) details of an assignment dated 25 Mar. 1698 [see Ne D 4137]; (d) details of the will of Sir Thomas Williamson dated 4 Apr. 1703 [see Ne D 4138]; (e) fact that Jane Williamson has assigned her interest in the sum of £500. to (1), and by a decree in chancery [see Ne D 4139] it has been agreed to sell the property; (f) decreed in chancery that the sum of £500. devised to (1) by Jane Williamson shall be paid and that the residue of the £2000. devised shall be put out for the benefit of the other beneficiaries; (g) the sum of £62.10.0. is agreed to be paid to (1) for the payment of other legacies and for the procuring of mourning rings as specified in the will.
(h) the principal sum and interest of £3919.11.8. is now due to John Hoskins on the said mortgage; (i) fact that several other sums of money are due to the creditors of Sir Thomas Williamson mentioned in the schedule annexed to his will, and that (3) has agreed with (1) and (2) to pay the sum of £7120.1.8. for the absolute purchase of all the premises; (j) further agreed between (1) and (2) that in consideration of the mortgage of 10,000 years and also the mortgage of inheritance for the protection of the term of 99 years, that (3) shall continue these terms; (k) fact that (3), at the direction of (1) and (2) has paid the sum of £3919.11.8. to Hoskins; (l) details of a lease and release dated 3-4 Mar. 1704 [wanting].
