Fourth Party: Charles Churchill, gentleman, of Uppingham, Rutland, Thomas Ince, gentleman, of Symond's Inn, Middlesex, William Saffery, gentleman, of St Clement Danes, Middlesex and John Houchen, gentleman, of Wareham, Norfolk.
Declaration by (1) and (3) with the consent of (2) that the money invested in bank annuities in the names of (4) is in trust to enable (1) to receive the profits until his two daughters become entitled to the reversion of one third part of the estate at Methwold, Norfolk; in case (1) should die before that time, upon trust for the profits to be paid to his daughters' guardians; covenant that after they reach their age of majority, the daughters will make further assurance of their one third part to (3); in the event that the daughters should refuse to make a further assurance as covenanted by (1), the bank annuities will be transferred to (3).
Recitals: (a) fact that at the time of his death John Jackson was seized of the property in question subject to a mortgage of £500; (b) lease and release dated 13 and 14 Aug. 1801 being the marriage settlement of Katherine Jackson and Bentley Warren; (c) fact that the marriage took place; (d) death of Katherine Warren leaving two daughters surviving from her marriage with Bentley Warren; (e) fact that (2) were the daughters of John and Katherine and are seized of two thirds of the property in question and that (1) is seized of the other third by virtue of his marriage settlement; (f) fact that it was agreed that the property should e sold and the mortgage discharged out of the purchase money; (g) fact that it was not possible to make an effectual conveyance of the property to (3) and so the purchase money was invested in public funds upon trusts; (h) fact that the money has been invested as agreed; (i) lease and release bearing even date; (j) bond bearing even date. |
