Release of (2) and (3) by (1) from certain restrictive covenants contained in a conveyance dated 24 Jun. 1944, in order to permit the erection of pivate dwellinghouses on property previously conveyed to (2) and (3) [being situated on Furival Street and Shrewsbury Road in Worksop].
Consideration: £1480 paid by (3) to (1); and £200 paid by (2) to (1).
Recitals: (a) fact that certain property was conveyed to (2) by conveyance dated 24 Jun. 1944, which conveyance contained a covenant to use the property for the purpose of a municipal housing estate only; (b) fact that an additional covenant was added to the aforementioned conveyance allowing the property to be used for the erection of churches, chapels, schools, shops, cinemas, and public halls, by deed dated 14 Apr. 1947; (c) fact that the benefit of the said covenants are now vested in (1); (d) fact that the property in question owned by (2) and (3) is shown on the accompanying plan [part of Ne 6 D 2/48/451/3]; (e) fact that (2) and (3) would like to sell the property for private housing, and have requested that (1) alter the restrictive covenants to allow this.
