Includes a right of way along the section of Athelstan Road coloured yellow on the plan, and the right to use the sewers, drains, gas, water and electricity mains lying beneath Athelstan Road; and the benefit of provisions contained in various indentures listed in the third schedule.

Recitals: (a) fact that the 7th Duke of Newcastle was seised of the property in question at the time of his death and fact that the 7th Duke had agreed to sell certain estates to (2) by indenture dated 5 Apr. 1927 but no conveyance was executed; (b) fact that the 7th Duke died 30 May 1928 having appointed (2) as executors of his will; (c) fact that one of the executors died on 8 Dec. 1939 and another died on 7 Nov. 1947; (d) fact that (1) and (2) have agreed to sell the property in question to (3).

Includes a plan with the property in question edged red, being bounded by Sparken Hill towards the west, Low Sparken Road towards the east, a [proposed?] housing development towards the north, and Hannah Park Wood towards the south; a right of way along Athelstan Road is coloured yellow; various drains and water mains are marked on the plan; also shows the approximate route of the proposed town planning road [the future A57?].
