Schedule 1: List of reservations to (1) and (2), namely all compensation payable under the Coal Act 1938; all mines and minerals contained in a lease dated 30 Oct. 1896 and varied by release dated 10 Dec. 1906; free passage of water, soil, gas and electricity; and the right to erect buildings on adjoining property belonging to (1) and (2).
Schedule 2: List of conditions and stipulations to be performed by (3), namely o maintain certain boundary fencing; not to erect any building beyond the building line of 60 feet; not to use the property for any trade/business or for the sale of intoicating liquor; not to keep any pig, cattle, sheep, goat or pigeon; not to erect any buildings other than 7 private dwellinghouses with an annual value of no less than £40; not to erect any building without prior consent from (2); not to make any alterations to the appearance of any existing building without the prior consent of (2); and not to allow any fences to fall into disrepair.

Recitals: (a) fact that most of the property in question was demised to Arthur Staniforth for a term of 99 years by indentures dated 9 Nov. 1894 and 8 Jul. 1898; (b) fact that the residue of the aforementioned terms on the property known as 'Netherfield' became vested in Edmund Bessell Whalley and his mortgagees; (c) fact that the residue of the terms was assigned to (3) by indenture dated 5 Apr. 1947; (d) fact that the 7th Duke had agreed to sell certain estates to (2) by indenture dated 5 Apr. 1927 but no conveyance was executed; (e) fact that the 7th Duke died 30 May 1928 having appointed (1) as executors of his will; (f) fact that one of the executors died on 8 Dec. 1939; (g) fact that another of the executors died 7 Nov. 1947 [added in pencil]; (h) fact that (1) and (2) have agreed to sell the property in question to (3).
