Conveyance from (1) and (2) to (3) of a property known as Elm Tree House on the road from Worksop to Ollerton [Sparken Hill], measuring 8586 square yards [described in first schedule and edged red on attached plan].

Property is subject to a lease for the term of 99 years to Mary Jackson, dated 29 Apr. 1899 [see Ne 6 D 2/48/156]; residue of the lease is now vested in (3).

Covenants by (3): To maintain certain boundary fencing; not to erect any building beyond the building line of 60 feet; not to use the property for any trade/business or for the sale of intoicating liquor, or keep any pig, cattle, sheep, goat or pigeon; not to erect any buildings other than 6 private dwellinghouses with an annual value of no less than £40; not to erect any building without prior consent from (2); not to make any alterations to the appearance of any existing building without the prior consent of (2); and not to allow any fences to fall into disrepair.

Consideration: £1100.

Schedule 1: Description of the property in question.

Schedule 2: List of reservations to (1) and (2), namely all compensation payable under the Coal Act 1938 and all mines and minerals below a depth of 300 feet from the surface; free passage of water, soil, gas and electricity; and the right to erect buildings on adjoining property belonging to (1) and (2).

Schedule 3: List of documents to which (3) has the right of production.

Recitals: (a) fact that the 7th Duke of Newcastle was seised of the property in question at the time of his death; (b) fact that the 7th Duke had agreed to sell certain estates to (2) by indenture dated 5 Apr. 1927 but no conveyance was executed; (c) fact that the 7th Duke died 30 May 1928 having appointed (1) as executors of his will; (d) fact that one of the executors died on 8 Dec. 1939; (e) fact that (1) and (2) have agreed to sell the property in question to (3).
