Conveyance from (1) and (2) to (3) of 107.389 acres of land in the borough of Worksop [described in first schedule and edged red on attached plan].

Subject to a mining lease with the Wigan Coal and Iron Company Limited dated 30 Oct. 1896, and varied by releases dated 10 Dec. 1906 and 3 Mar. 1931; also subject to a corn rent of £3.9.7 payable to the Vicar of Worksop.

Reservations to (1) and (2): All compensation payable under the Coal Act 1938 and all mines and minerals below a depth of 300 feet from the surface; free passage of water, soil, gas and electricity; the right to erect buildings on adjoining property belonging to (1) and (2); and all rights, liberties and powers granted by a conveyance dated 15 Jul. 1931, a demise dated 1 Apr. 1940, and and a conveyance dated 31 Dec. 1915.

(3) covenants to erect and maintain certain boundary fencing.

Consideration: £8000.

Schedule 1: Description of the property in question.

Schedule 2: List of provisions and rights to which the property is subject, namely an agreement with Worksop Urban District Council dated 16 Nov. 1929; an agreement with (3) dated 4 Jan. 1936; the right of (3) to maintain electricity lines between points P and R on the plan; a conveyance with the Rural District Council of Clown dated 15 Jul. 1913; a conveyance with the Urban District Council of Worksop dated 31 Dec. 1915 [all relating to the placing of electricity lines or water supply].

Schedule 3: List of documents to which (3) has the right of production.

Recitals: (a) fact that the 7th Duke of Newcastle was seised of the property in question at the time of his death and fact that the 7th Duke had agreed to sell certain estates to (2) by indenture dated 5 Apr. 1927 but no conveyance was executed; (b) fact that the 7th Duke died 30 May 1928 having appointed (1) as executors of his will; (c) fact that one of the executors died on 8 Dec. 1939; (d) fact that (1) and (2) have agreed to sell the property in question to (3).

Includes a plan with the property in question edged red, being a large area of land situated to the east of Netherton Road; the property is crossed by a proposed Town Planning road [probably the A57 Worksop by-pass?].
