Conveyance from (1) and (2) to (4), and surrender from (3) to (4) of a property known as 'Parkfield' situated on the eastern side of the main road leading from Worksop to Ollerton [Sparken Hill]; measuring 3068 square yards [described in first schedule and edged red on attached plan]; includes a right of way over the private road coloured yellow on the plan and the right to use the drains, pipes and cables running beneath the aforesaid road, provided that (4) pays part of the costs for repairs.

Property is subject to a lease to Frederick Bardwell dated 10 Nov. 1882 for a term of 72 years, which was subsequently assigned to (3) by indenture dated 9 May 1934.

Also subject to a mining lease with the Wigan Coal and Iron Company Limited dated 30 Oct. 1896, and varied by release dated 3 Mar. 1931.

Covenants by (4): Not to use the property in question for any business or trade other than for a doctors surgery, but not for a nursing home or residence for patients; not to keep any pig, cattle, sheep or goat; not to erect any building or division fences on the property without prior consent from (2); not to make any alterations to the appearance of any building on the property; to pay one third of the costs for repairing the aforementioned private road; and to repair and maintain all drains, watercourses and pipes beneath that part of the private road which abutts on the property in question.

Consideration: £1702.16.3 in total; being £702.16.3 payable to (2), and £1000 payable to (3).

Schedule 1: Description of the property in question.

Schedule 2: List of reservations to (1) and (2), namely all mines and minerals lying below a depth of 300 feet; free passage of water and soil; and the right to erect buildings on adjoining property belonging to (1) and (2).

Schedule 3: List of documents to which (3) is entitled production of.

Recitals: (a) fact that the 7th Duke of Newcastle was seised of the property in question, which was subject to a lease to Frederick Bardwell dated 10 Nov. 1882 for a term of 72 years, and fact that the 7th Duke had agreed to sell certain estates to (2) by indenture dated 5 Apr. 1927 but no conveyance was executed; (b) fact that the 7th Duke died 30 May 1928 having appointed (1) as executors of his will; (c) fact that the premises demised by the aforementioned lease became vested in (3) by assignment dated 9 May 1934; (d) fact that (1) and (2) have agreed to sell the property in question to (4).

Includes plan with the property in question edged red; the private road belonging to (2) over which (4) has right of way is coloured yellow; a key plan also shows Sparken Hill and Park Street.
