Conveyance from (1) and (2) to (3) of a piece of land measuring 162 square yards, situated at the junction of Elkesley Lane and Retford Road in the parish of Worksop [property described in first schedule and coloured pink on attached plan].
Covanants by (3): To erect certain boundary fencing; to erect a gate; to form an approach road; to repair any drains and ditches damaged by the aforesaid works or any road widening operations; to carry out the aforesaid works to the satisfaction of (2); and not to use the property in question for any purpose other than road improvements.
Covenants by (2): To indemnify (3) from payment of the aforesaid corn rent charge; to indemnify (3) from all costs in respect to construction of the new roads between the points marked O-P, I-J, K-L, M-N on plan; to construct the proposed road between points marked A-C on plan within 2 years, the cost being shared between (2) and (3).
Schedule 1: Description of property in question.
Schedule 2: Reservations to (1) and (2), namely all mines and minerals; the reversion expectant on a mining lease; and free passage of water and soil.
Schedule 3: List of documents to which (3) has the right of production.
Recitals: (a) fact that the 7th Duke of Newcastle was seised of the property in question at the time of his death, and that the 7th Duke had agreed to sell certain estates to (2) by indenture dated 5 Apr. 1927 but no conveyance was executed; (b) fact that the 7th Duke died 30 May 1928 having appointed (1) as executors of his will; (c) fact that (1) and (2) have agreed to sell the property in question to (3).
