Conveyance from (1) and (2) to (3) of a parcel of land measuring 2.277 square yards situated near the road leading from Worksop to East Retford [Retford Road]; property bounded towards the north and south by proposed roads [possibly Radford Street and Pelham Street?]; includes a right of way over part of the proposed roads after they have been constructed, as long as (3) pays part of the cost for constructing and maintaining the roads until taken over by the local authority.

Reservations to (1) and (2): All mines and minerals lying below a depth of 300 feet, and the reversion expectant on a mining lease; free passage of water and soil; the right to erect buildings on adjoining property belonging to (1) and (2); a right to enter property edged yellow on the plan for the purpose of constructing and maintaining the proposed roads; and a right of way over the property edged yellow on plan once the roads have been constructed.

Discharges and indemnifies (3) from a Rectorial Tithe Rent Charge of 2 shillings and 3 pence halfpenny, and a Corn Rent Charge of 9 pence halfpenny.

Subject to a mining lease with the Wigan Coal and Iron Company Limited dated 30 Oct. 1896, and varied by indenture dated 10 Dec. 1906.

Covanants by (3): To erect certain boundary fencing; not to erect any building beyond the building line of 20 feet; not to use the property in question for any noisy or offensive trade or public house provided that nothing shall be deemed to prohibit the property from being used as a fish and chip shop; to reserve the part of the property edged yellow on the plan for roads and footpaths only; not to erect any building on the property without prior consent from (2); and to erect a temporary fence between points marked 'E', 'F' and 'B'.

Consideration: £60.17.1.

Recitals: (a) fact that the 7th Duke of Newcastle was seised of the property in question at the time of his death; (b) fact that the 7th Duke had agreed to sell certain estates to (2) by indenture dated 5 Apr. 1927 but no conveyance was executed; (c) fact that the 7th Duke died 30 May 1928 having appointed (1) as executors of his will; (d) fact that (1) and (2) have agreed to sell the property in question to (3).

Includes plan with the property in question edged red; shows proposed roads.
