Conveyance from (1) and (2) to (3) of a parcel of land situated on the eastern side of the road leading from Worksop to Ollerton [Sparken Hill] measuring 1.340 acres and containing a dwellinghouse known as 'Woodleigh' [property edged red on attached plan]; includes the right to enter adjoining property belongining to (1) and (2) for the purpose of inspecting and repairing an existing drain.

Subject to a mining lease with the Wigan Coal and Iron Company Limited dated 30 Oct. 1896, and varied by release dated 3 Mar. 1931.

Discharges and indemnifies (3) from a Rectorial Tithe Rent Charge.

Reservations to (1) and (2): All mines and minerals lying below a depth of 300 feet; the reversion expectant on the mining lease; free passage of water and soil; and the right to erect buildings on adjoining property belonging to (1) and (2).

Covanants by (3): To erect certain boundary fencing; not to erect any building beyond the building line of 60 feet; not to use the property in question for any noisy or offensive trade, public house or keep any pig, horse, pony, cattle, sheep, goat, fowl, or pigeon; not to erect any buildings other than 6 private dwellinghouses with an annual value of no less than £40; not to erect any building on the property without prior consent from (2); not to make any alterations to the appearance of any building on the property; not to use any coloured glass in windows of any building; and not to allow any internal or division fences to fall into disrepair.

Consideration: £353 and 8 shillings.

Recitals: (a) fact that the 7th Duke of Newcastle was seised of the property in question at the time of his death; (b) fact that the property in question was leased to Arthur Staniforth for the term of 99 years by lease dated 16 May 1917; (c) fact that the 7th Duke had agreed to sell certain estates to (2) by indenture dated 5 Apr. 1927 but no conveyance was executed; (d) fact that by mortgage dated 17 May 1917 the lease was demised to Michael and Harold Van der Gucht; (e) fact that Harold Van der Gucht died 16 Sep. 1917 and Michael Van der Gucht died 8 Sep. 1918; (f) fact that the mortgage was transferred to John Edward Hodding and Cecil Newton Graham by indenture dated 18 Mar. 1920; (g) fact that the premises were assigned to Cecil Newton Graham for the residue of the aforementioned lease by indenture dated 1 Oct. 1920; (h) fact that the mortgage was transferred to George Edward Graham; (i) fact that Cecil Newton Graham made a will dated 11 Dec. 1920 and named (3) as executrix; (j) fact that Cecil Newton Graham died 29 Oct. 1929; (k) fact that George Edward Graham died 21 Dec. 1932; (l) fact that the principal sum of money secured by the aforementioned mortgage was paid off by (3); (m) fact that property was vested in (3) for the remainder of the term of the lease, by assent dated 8 Feb. 1933; (n) fact that (1) and (2) have agreed to sell the property in question to (3).
