Conveyance from (1) and (2) to (3) of 5 acres of land situated near Lincoln Street in Worksop [described in schedule 1 and coloured pink on attached plan]; includes a right of way along 2 proposed roads

Subject to a mining lease with the Wigan Coal and Iron Company Limited dated 30 Oct. 1896, and varied by indenture dated 10 Dec. 1906.

Reservations to (1) and (2): All mines and minerals below a depth of 300 feet from the surface; the reversion expectant on a mining lease; free passage of water and soil; the right to erect buildings on adjoining property belonging to (1) and (2); the right to enter the proposed roads in order to construct the roads and lay pipes, cables etc; and a right of way along the proposed roads.

Indemnifies (3) from all corn rent charges, and also from all liability in respect of the proposed roads.

Consideration: £500.

Schedule 1: Description of property in question.

Schedule 2: List of restrictions and stipulations, namely to erect certain boundary fencing; to only use the property for the erection of a school and related buildings, and not for any other purpose or for any noisy or offensive trade or public house or pigsty; to pay part of the costs for construction and maintenance of the proposed roads until taken over by the local authority.

Schedule 3: List of documents to which (3) has the right of production.

Recitals: (a) fact that the 7th Duke of Newcastle was seised of the property in question at the time of his death and fact that the 7th Duke had agreed to sell certain property to (2) by indenture dated 5 Apr. 1927 but no conveyance was executed; (b) fact that the 7th Duke died 30 May 1928; (c) fact that (1) and (2) have agreed to sell the property in question to (3).
