Content Description | First Party: Henry P.A.D. [Pelham-Clinton] 7th Duke of Newcastle [under Lyne].
Second Party: Wigan Coal and Iron Company Limited. Agreement between (1) and (2), whereby (2) covenant that they will work out the coal lying underneath the property edged pink on the attched plan as expeditiously as possible and in one continuous long wall face; (2) covenants to pay compensation to (1) for damage caused to buildings by the working; (1) covenants that (2) are not required to give notice for this work.
Contains various other related covenants.
Recitals: (a) fact that principal indenture dated 30 Oct. 1896 specified that (2) must give notice of their intention to work any coal deemed as support for buildings lying under certain land; (b) fact that (2) want to work coal lying under property edged pink on plan, and it has been agreed that they do not need to provide notice of such.
Includes plan with the property in question edged pink; Sparken House lies within the boundary; pencil note states that the area of land measures 38 statute acres.
