Subject to a mining lease with Wigan Coal and Iron Company dated 30 Oct. 1896, and varied by indenture dated 10 Dec. 1906.
Reservations to (1): All mines and minerals below a depth of 300 feet from the surface; all freehold reversion expectant on the mining lease; the free passage of water and soil; the rectorial tithe rent charge; the right to erect buildings on adjoining property; and the right of way along the moiety of the proposed road .
Consideration: £252 and 15 shillings.
Schedule 1: List of covenants by (2), namely to erect a building on the property within 12 months; to erect a brick wall along a certain boundary and a fence along another boundary within 6 months; not to use the property for any noisy or offensive trade, or for use as a public house; to pay part of the costs for constructing and maintaining the proposed road until taken over by the council, ans also to pay any streetage charge for widening Kilton Road.
