Subject to a mining lease with the Wigan Coal and Iron Company dated 30 Oct. 1896 and varied by indenture dated 10 Dec. 1906; also subject to the provisions of the Public Health Acts and the Highways and Locomotives (Amendment) Act 1878.
Reserves all minerals below a depth of 300 feet from the surface to (1), including the freehold reversion expectant upon the lease; also reserves the free passage of water and soil.
(2) covenants to use the property in question for the improvements to Retford Road, to carry out the improvement in a substantial and satisfactory manner, and to erect certain new fencing at their own cost.
Recitals: (a) fact that property in question is subject to a mining lease; (b) fact that (2) desire to carry out improvements to Retford Road; (c) fact that (1) has agreed to convey the property in question to (2).
