Conveyance from (2) and (3) to (4) [with permission of (1)] of 30 acres and 22 perches of land in the parishes of Whitwell, Derbyshire and Worksop, Nottinghamshire under The Midland Railway Act 1865 for the purpose of building a railway from Mansfield to Worksop; also 6 acres and 26 perches of land in the parish of Worksop for the purpose of building a junction with the Manchester, Sheffield and Lincolnshire Railway [shown on attached plan and listed in Schedule 1].

Consideration: £6100.

Recitals: (a) recites lease and release dated 4-5 Jun. 1839; (b) recites lease and release dated 7-8 Jun. 1839; (c) will of the 4th Duke of Newcastle under Lyne dated 14 Aug. 1846 bequeathed the Worksop Manor and Shireoaks estates to his son Lord Charles Pelham Pelham-Clinton; (d) fact that the 4th Duke of Newcastle under Lyne died 12 Jan. 1851; (e) recites indenture dated 28 Apr. 1851; (f) recites mortgage dated 9 Aug. 1851; (g) recites agreement for conveyance from Lord Charles Pelham Pelham-Clinton to the 5th Duke of Newcastle under Lyne of the Worksop Manor and Shireoaks estates aforesaid dated 8 Dec. 1851; (h) fact that no conveyance was executed; (i) will of 5th Duke of Newcastle under Lyne dated 21 Jul. 1856; (j) fact that the 5th Duke made a codicil to his will dated 17 Jan. 1859 which appointed (2) to be trustees during the life of (3); (k) fact that the 5th Duke made a further codicil dated 1 Apr. 1864; (l) recites mortgage dated 18 Jun. 1866; (m) fact that (4) has agreed to purchase the property in question under The Midland Railway Act 1865; (n) fact that it is agreed that the purchase cost will be £6100; (o) fact that £90,000 is still owing on mortgage; (p) fact that (1) has agreed to the sale; (q) fact that purchase money of £6100 has already been paid by (4).

Includes plan with the parcels of land shaded pink; note that the land conveyed is mainly in the Steetley area of Nottinghamshire/Derbyshire; plan shows 'The Holme', 'Holme Carr', Steetley Wood, Haggonfields, and the Manchester, Sheffield and Lincolnshire Railway.
