Surrender from (1) to (3) [by the direction of (2)] of the remainder of a 21 year lease dated 30 Jun. 1856 on Worksop Manor House and grounds measuring 20 acres; also 3 lawns or parkland measuring 176 acres, 153 acres of which is pasture and 23 acres of which is arable; also 3 gamekeepers cottages, one being near the manor house, one being at Hawksnest and the other at Sparking [Sparken] Hill [also describes map which accompanied lease].
Recitals: (a) fact that the 5th Duke of Newcastle leased the property in question to Thomas Henry Foley, 4th Baron Foley for a term of 21 years by indenture dated 30 Jun. 1856; (b) fact that the 5th Duke of Newcastle by his will dated dated 21 Jul. 1856 devised certain estates to Lord Robert Renebald Pelham-Clinton and (3) to hold in trust for 1000 years; (c) fact that by codicil dated 17 Jan. 1859 the 5th Duke of Newcastle made Sidney Herbert and William E. Gladstone Trustees to his will; (d) fact that Sidney Herbert died and was replaced by Lord de Tabley; (e) fact that the 5th Duke of Newcastle died 18 Oct. 1864; (f) fact that Lord Robert Renebald Pelham-Clinton died 25 Jul. 1857; (g) fact that 4th Baron Foley died 20 Nov. 1869 and had appointed (1) as his executors; (h) fact that all rent is up to date; (i) fact that it has beed agreed that (1) should surrender the property contained in the aforementioned lease. |
