Content Description | Directs that all his debts and funeral charges be paid, together with the several legacies bequeathed.
Devises to his son Robert Arkwright the following: his mansion house known as Sutton Hall, together with the domain known as Sutton cum Duckmanton in Derbyshire, with all manors, advowsons, parks, woods, farms and so on, which were purchased of the Marquess of Ormonde; all chief, fee farm and quit rents; and all other property of whatever tenure in Sutton cum Duckmanton; the residue of several terms of the lease of the rectorial tithe of Cestersover? at Streetfield, Warwickshire held of the Master and Fellows of Trinity College, Cambridge; the mansion house at Willersley, Derbyshire with all outbuildings, gardens, lands and so on; his share of the manor of Matlock, Derbyshire with all messuages, mills and other property, both freehold and copyhold; all leasehold property in Matlock; the manor of Cromford and all property in Cromford, Wirksworth and Bonsall [all Derbyshire]; the advowson and right of patronage of the chapel at Cromford; all property at Cowley, Derbyshire; the undivided moiety of the manors of Lea and Holloway and all tithes arising from lands in Crich, Derbyshire; property in Manchester, Mellor [Derbyshire] and Marple [Cheshire] together with all machinery and equipment in the mills.
Bequeaths the following to his son Peter Arkwright; property in Marple and Mellor; all household furniture, pictures, books, plate, linen, wines, liquors, live and dead stock, carriages, hay and so on from the mansion house at Willersley; the lease of the manor and wapentake of Wirksworth with mineral rights for the residue of several terms; the sough known as Long Sough or Cromford Moor Sough and all mines and mineral duties in the wapentake of Wirksworth.
Gives the following to his son John Arkwright: all his property in Herefordshire; all leasehold estates and property in Herefordshire for the residue of several terms.
Devises the following to his son Charles Arkwright: the manor of Dunstall, Staffordshire with all messuages, farms and lands; the manor of Skerne, Yorkshire with all messuages, farms and lands, together with the advowson to the perpetual curacy of Skerne.
Bequeaths the following to his son Joseph Arkwright: all manors and property in Essex and Hertfordshire; the manor of Normanton Turville and the advowson of the rectory of Thurleston, both in Leicestershire, with all other property in Normanton Turville.
Bequeaths his share in mines and mineral duties in Crich to his son in law, Francis Hurt; makes substantial legacies to named family members including to his sons, daughters, grandchildren, nephews and nieces; bequeaths legacies to any servants living with him at the time of his death and a specific legacy to his gardener.
Gives to his sons, Robert, Peter and Charles the sum of £50,000 3.5% Reduced Bank Annuities, in trust that they will during the lifetime of his daughter Ann Wigram pay the dividens and annual produce of the said sum to Ann for her sole and separate use; after the decease of Ann, the money shall remain in trust for any of her children as directed by her will; further details provided as to how the sum will continue in the event of children being of age or married after the death of Ann in the hands of the above, as trustees.
Statement that his daughter, Frances Arkwright is entitled by the will of his father, Sir Richard Arkwright, to a legacy of £5000, and the further sum of £1250; neither amount has been paid by the testator as executor of his father's will and makes arrangements for the payment and investment of this sum via his sons; his sons or trustees are to ensure that such arrangements are in place for the comfortable support and maintenance of his daughter Frances; provision made if the annual income of the invested money is more than required, the surplus shall be re-invested; declaration that his personal estate is to be charged with the sums of £5000 and £1250, but if there is insufficient money then the shortfall is to be made up from the monies bequeathed to his sons.
Directs that all legacies bequeathed by his will are to be paid by his executors within 6 months of his death; declaration that the legacy duty on all his bequests is to be paid by his executors from his personal estate.
Bequeaths to his son Charles and his grandson Francis Hurt the sum of £4000. on trust to invest the same in government or real securities; directs that the sum be paid to them as soon as conveniently possible after his death; further directs that this sum of £4000. and any other charitable bequests are to be paid exclusively from his personal estate and are to be paid in preference to all other pecuniary legacies; the sum of £4000 above is on a further trust to provide payment of the salary of the organist of Cromford Chapel and also for the 'cleaning upholding repairing and beautifying the said Chapel'; provision made for the trustees and the patron of the chapel to invest the money for the use of the curate or incumbent; provision made for the appointment of new trustees if either Charles Arkwright or Francis Hurt should die.
Gives the sum of £10,000 to his executors in trust to pay appropriate small sums at their discretion to any persons or charitable causes; directs that his executors will not be accountable for their decisions; bequeaths a further £200 to his executors on trust to pay the treasurers of a society known as the Govenors of the Derbyshire General Infirmary; a further £200 to be held on trust to pay the treasurers of a society known as the Governors of the General Hospital, Nottingham; and a further £200 to be paid to the Trustees of the Public Infirmary Dispensary Lunatic Hospital and Asylum, Manchester.
Residue of his estate is bequeathed to his sons Robert, Peter, Charles and Joseph, to be equally divided amongst them as tenants in common.
