Assignment from (1) to (2) of the principal sum of £4500., being part and parcel of the sum of £12,500. bequeathed to (1) by his father; note that the sum of £4500. is part of the greater sum of £25,000. due and owing to (2) as executor of his father's will as part of the security for a mortgage from the [12th] Duke of Norfolk; contains usual covenants.

Recitals: (a) details of the will of the late James Oakes [see Ne 6 D 2/47/206]; (b) fact that James Oakes died in 1829 without revoking the will in particular the disposition of the sum of £25,000. secured as mortgage for the estates of the [12th] Duke of Norfolk, and that the will was duly proved by (2); (c) fact that the security from the 12th Duke of Norfolk was subsisting at the time of death of James Oakes and is still subsisting now; (d) (2) at the request of (1) has agreed to advance the sum of £4500., part of the sum of £12,500. bequeathed to him.
