Content DescriptionFirst Party: Bernard Edward [Howard, 12th] Duke of Norfolk.

Second Party: Henry Charles Howard, commonly called Earl of Surrey [later 13th Duke of Norfolk], only son and heir apparent of (1).

Third Party: George Howard, Lord Viscount Morpeth [later 6th Earl of Carlisle]; and George Petre, esquire of Melton Mowbray, Leicestershire.

Fourth Party: James Oakes, esquire of Bury St Edmunds, Suffolk.

(1) charges all the property listed in schedule A [attached] with the payment of £25,000 with interest to (4); (1) limits and appoints all the property specified to the use of (4) for a term of 3000 years subject to several provisos; declaration between (1) and (2) as those entitled to the freehold and inheritance of the premises as set out in the settlement recited at (a) below, will pay to (4) the sum of £25,000. with interest on a specified date; (1) covenants with (4) to ensure that all interest on the mortgage is paid, and (2) covenants to continue the repayments in the event of (1)'s death; contains further provisos relating to the repayment of the mortgage

Includes two schedules; schedule A lists all the property specified [see ff 8-13]; and schedule B lists all the indentures referred to [see ff 13-14].

Recitals: (a) details of an indenture of lease and release dated 24 and 26 Dec. 1814 [see Ne 6 D 2/47/202]; (b) fact that (1) is now in actual possession of the castles and various hereditaments and desires to raise the sum of £25,000 in pursuance of the power vested in him, and has applied to (4) to advance the same.
