Lease and release from (2) at the request of (1), to (3) of several messuages, closes or parcels of land, with all manner of heriditaments and appurtenances in Whitwell, Derbyshire; noted that the property is that recited at (b) below.

Details of the property are: a messuage in the occupation of Edward Allison and the following closes of land [in all cases acreages are provided]: Quarry Close Meadow, Quarry Close, Nether Coldwell Close, the Bottoms, Great Coldwell Close, the Pingle, Clapper Fields, Turn? Pingle, Upper Thistle Field, Nether Thistle Field, Little Coldwell Close, Wood Bottoms, the Old Lane, Thistley Close, Pudding Poke Close, Thistley Field, Calf Close, the Orchard, a parcel of land on which the homestead stands, and part of Homestead Close.

Also of a messuage in Whitwell in the occupation of Robert Milner and the following closes [details of acreages provided]: Ford Close, Ford Field, High Field Bottoms, High Field, Spring Close, Thorpe Field, Chapel Yard, land on which the homestead stands, part of Homestead Close, Whitfield, Pencroft and Nether Shireoaks Close.

All the above property was once part of Steetly Farm in the occupation of Ralph Hancock.

Recitals: (a) details of an indenture of lease and release dated 10-11 Jun. 1767; (b) details of an indenture of lease and release dated 15-16 Jan. 1770; (c) details of a deed poll dated 28 Apr. 1770; (d) fact that no settlement was ever made in pursuance of the trust declared by the deed poll at (c) above; (e) fact that Edward [Howard, 9th] Duke of Norfolk died in 1777 without issue, and so Charles Howard the elder became [10th] Duke of Norfolk and he died in 1786 without any other issue than Charles Howard the younger [later 11th Duke of Norfolk]; (f) details of an indenture of lease and release dated 25-26 Nov. 1814; (g) details of an indenture of lease, appointment and release dated 25-26 Dec. 1814; (h) fact that Charles [11th] Duke of Norfolk died in 1815 without any male issue, and so Bernard Edward Howard became [12th] Duke of Norfolk and Henry Charles Howard assumed the title Earl of Surrey; (i) details of an indenture dated 12 Aug. 1837; (j) details of an act of parliament made 1-2 Victoria [1837-1839] concerning the settlement of the Duke of Norfolk's estates; (k) details of an indenture of lease, appointment and release dated 12-13 Mar. 1839; (l) fact that William [Wentworth, 2nd] Earl of Strafford in whom the legal estate of the property in Derbyshire is vested died in 1791 intestate and without issue; (m) by virtue of the line of descent, as shown in the attached pedigree, the legal estate of the property is now vested in (2) as the heirs at law of 2nd Earl of Strafford.
