Assignment from (1) at the request of (2) and on the nomination of (3), to (4) of property [comprising messuages and lands, known as the Birks estate in the parish of Whitwell, Derbyshire] for the unexpired residue of the several terms of 500 and 1000 years; contains usual covenants.

Property in detail comprises: a messuage or tenement known as Birks Hall in the parish of Whitwell, together with all outbuildings and appurtenances and the following parcels and closes of land: Upper Reynolds, Near Reynolds, Far Reynolds, Stony Croft, Far Wood Close, Near Wood Close, Upper Daizies, Nether Daizies, Great Tenter Yard, Homestead, Little Tenter Yard, Gospel Yard, Wood Close, Wood Nooking, Gospel Spring, the Lane, Well Yard, the Orchard, and part of Ratcliffe Yard; also of a messuage with outbuildings, gardens and orchard at Ratcliffe in the parish of Worksop, with the following parcels of land: part of Ratcliffe Yard, Nether Flat, Upper Flat, Over Field, Near Netherfield, Far Netherfield, Far Carr Close, Near Carr Close, the holt or wood, Carr Meadow, Windmill Close or Smiths Croft, Near Flat, and part of the Pond Close; [in all cases details of acreages are provided].

Recitals: (a) details of an indenture of mortgage dated 25 Mar. 1788; (b) details of the will of Thomas Fletcher the elder dated 25 Jan. 1792; (c) fact that Thomas Fletcher the elder died in 1796 without revoking his will; (d) details of an indenture of mortgage dated 2 May 1803 [see Ne 6 D 2/47/94]; (e) fact that Thomas Fletcher the younger died in 1808 intestate; (f) details of the will of William Davy dated 17 Dec. 1810; (g) fact that William Davy died without revoking his will and his son, Samuel, duly proved the will; (h) details of the Worksop enclosure award; (i) details of the will of John Parkin dated 27 Feb. 1818, and who later died in 1820; (j) details of an indenture of assignment dated 3 Jul. 1823 [see Ne 6 D 2/47/117]; (k) details of an indenture of lease and release dated 4-5 Jul. 1823 [see Ne 6 D 2/47/118-119]; (l) details of the will of Henry Keyworth dated 8 Apr. 1825, and the fact that he died in 1825 without revoking his will; (m) fact that Samuel Davy the father died in 1836 intestate, leaving (2) as his surviving son and heir; (n) details of an indenture of lease and release dated 1-2 Dec. 1837 [see Ne 6 D 2/47/125]; (o) agreement that the property vested in (1) for the residue of the terms of 500 and 1000 years should be assigned to a trustee for (3).
