Third Party: Robert Pashley, liquor merchant of Worksop, Nottinghamshire.

For the barring and extinguishing of all estates tail and any remainders, covenant by (1) to (2) to levy and lead uses of a fine on an estate in the parishes of Whitwell and Worksop; the property includes a capital messuage known as Birks Hall in the parish of Whitwell together with all outbuildings and appurtenances and the following parcels and closes of land: Upper Reynolds, Near Reynolds, Far Reynolds, Stony Croft, Far Wood, Near Wood Close, Upper Daizies, Nether Daizies, Great Tenter Yard, Tenter Yard, Gospel Yard, Wood Close, Wood Nooking, Gospel Spring, the Lane, Well Yard, the Orchard, and part of Ratcliffe Yard; also land on Whitwell Common allotted to Samuel Davy and John Fletcher under the Whitwell Enclosure.

Also of a messuage which has been divided into 2 cottages with outbuildings, gardens and orchard at Ratcliffe in the parish of Worksop, with the following parcels of land: part of Ratcliffe Yard, Nether Flat, Upper Flat, Over Field, Near Netherfield, Far Netherfield, Far Carr Close, Near Carr Close, the holt or wood, Carr Meadow, Windmill Close or Smiths Croft, Near Flat, and part of the Pond Close; in all cases acreages are provided; also of a pew in Worksop parish church.

Covenants that any fines of the property levied will enure to the various uses specified, including: one undivided moiety of the property above described to the use of Samuel Davy and his assigns for life, and to the use of (3) during the lifetime of (1) in trust to prevent any future wife of Davey from being entitled to the dower in the property after his decease; the other undivided moiety of the property to such uses and trusts as specified by (2) for life, and for (3) in trust for (2) to prevent any future from being entitled to the dower of the property also.
