Reserved to (1): firstly, all rights of way, water, light, and other easements, and all mines and minerals; secondly the right to work the minerals or strata under adjoining land without the obligation to leave any vertical support for the surface land, also lists various clauses regarding damage to the surface of the land and compensation; thirdly all rents and royalties payable by the lessees to (1) under the mining lease [see recitals below]; fourthly free passage of water and soil from adjoining lands belonging to (1); and fifthly the right to erect buildings on neighbouring land.

Recitals: (a) fact that (1) is seised of the property in question which is subject to a jointure rent charge of £3000 per year payable to Adele Henrietta [Pelham-Clinton] Dowager Duchess of Newcastle by an indenture dated 5 Jul. 1861, and also subject to a mining lease with the Wigan Coal and Iron Company dated 30 Oct. 1896; (b) fact that (1) has agreed to sell the property to (2).
