Agreement that (1) and (2) will give up a parcel of land measuring 496 square yards adjoining the road from Ollerton to Bawtry within the parish of Babworth, Nottinghamshire [note that the land was formerly part of Ranby Cottage Farm]; notes that the land is subject to both surface and mining leases [details provided]; agreement that the land will become part of the public highway; reserves to (1) and (2) all mineral rights, the reversion of the mining lease, full and free passage and running of water and soil and full and free right to build on adjoining land; agreement that if required, (1) and (2) will prove their title at the expense of (3); (3) will form the road and will erect a boundary fence.

Recitals: (a) fact that the late 7th Duke was seized of estates in Nottinghamshire and that by an agreement dated 5 Apr. 1927 he agreed to sell the property to (2); (b) death of the 7th Duke and details of his will; (c) fact that (2) have agreed to give up the land in question for the purposes of widening and improving a road. |
