Recitals: (a) mortgage dated 28 Apr. 1863; (b) death of Edward Marjoribanks, one of the mortgagees; (c) details of the will of Sir Edmund Antrobus; (d) death of Sir Edmund Antrobus and proving of his will; (e) fact that (2) is entitled to the equity of redemption of (a) above; (f) settlement dated 29 Sep. 1885; (g) indenture dated 14 Oct. 1892 by which the limitations contained in (f) above were altered; (h) indenture dated 22 Dec. 1892 by which the limitations were further altered; (i) deed poll dated 26 Mar. 1895; (j) death of the Duke of Hamilton; (k) fact that the sum of £48,000 remains owing under (a) above; (l) fact that (2) wishes to pay off the £48,000 and has asked (1) to make a reconveyance. |
