Second Party: The Southwell Diocesan Borad of Finance.
Release from (1) to (2) of the trust fund established by (a) below to the intent that the trust may bge declared revoked; discharge by (2) of all future responsibility for maintaining, repairing and insuring the chancel of North Muskham Parish Church.
Recitals: (a) fact that this deed is supplemental to a deed dated 30 Oct. 1913 by which £250 2½% consolidated stock was settled on trust for a trust fund to discharge the cost of repairs to the chancel of North Muskham Church and also to an appointmend dated 12 Aug. 1929 appointing trustees to the principal deed above; (b) death of the 7th Duke of Newcastle under Lyne and details of his will; (c) resolution passed 11 Nov. 1941 by which it was resolved that the trust fund created by the principal deed recited at (a) above should be transferred to the board but that no deed of appointment was executed; (d) fact that the trust sum is now represented by £628.12s. of 2½% consolidtaed stock; (e) fact that the parties in question wish to have the liabilities for repairs and insurance discharged under section 23 of the Ecclesiastical Dilapidations Measure 1923; (f) fact that (2) have been appointed to act as trustees for the diocesan trust property. |
