Release by (1), (2) and (3) to (4) of all surface rights over strips or parcels of land in the parish of Harworth, measuring 2 acres 3 roods and 23 perches [as shown on attached plan], reserves the right to survey the land; mentions that the strips of land in question are to be used to wdien the railway [London and North Eastern Railway].
Recitals: (a) fact that the property called the Martin Estate was conveyed by (1) and others to Benjamin I. Whitaker 2 Oct. 1891, by which certain surface rights were reserved to (1), and that the property in question formed part of that estate; (b) fact that the mineral rights and above mentioned surface rights for the Martin Estate were leased by (1) to (2) 20 Oct. 1896; (c) fact that (2) sub-leased certain of these rights to (3) by lease dated 30 Nov. 1923; (d) fact that (4) is tenant for life of Martin Estate under the will of Benjamin I. Whitaker dated 24 Jul. 1905 [proved 9 Aug. 1922], including strips of land desired by The London and North Eastern Railway Company for widening their line.
