Conveyance from (1) and (2) to (3), through (4), of a parcel of land in Gamston, measuring 2 roods [full description of boundaries given, and parcel shown on attached plan]; the right to free and uninterupted running of water and soil from property, right to erect buildings on adjoining land, and all minerals reserved to (2); conveyance subject to a Mining Lease and a yearly rent charge [see recitals below]; compensation for damage to the surface land to be paid by the lessee [the Wigan Coal and Iron Company Ltd]; conveyance also subject to the right of (2) to work and carry away all minerals without any obligation to leave adequate support for the surface land or to pay any compensation for damage caused by the working; (3) covenants to erect and maintain a fence on the southern boundary of the property, and to not to make or open any windows on the southern boundary so as to overlook the adjacent property of (2); (2) covenants that the yearly rent charge of £3000 [see recitals below] shall be primarily charged on other properties and that (3) is indemnified against the aforementioned rent charge; (2) and (1) acknowledge (3)'s right to the production of the deeds listed in Schedules 1 and 2.

Recitals: (a) fact that firstly the property in question is subject to a yearly rent charge of £3000 in favour of Adele Henrietta Hope [Pelham-Clinton] Dowager Duchess of Newcastle under Lyne by indenture dated 5 Jul. 1861, and secondly is subject to a mortgage of £60,000 [now reduced to £50,000] made between (2), John Croft Deverall and (1), dated 3 Jun. 1896, and thirdly is subject to a Mining Lease between (2) and the Wigan Coal and Iron Company Ltd, dated 30 Oct. 1896; (b) fact that (2) has agreed to sell the property to (3) with the reservations and exceptions above.

Includes a plan of the property in question coloured pink and bounded in red; Glebe land is shown to the north of the propery, Church Lane is shown to the west, and land owned by the duke is shown to the east and south; plan drawn at a scale of 1 chain to the inch; there is a compass showing north.
