Third Party: The Mayor, Aldermen and Burgesses of the Borough of Newark-upon-Trent, Nottinghamshire.

Gift from (1) to (3) at the direction of (2) of two pieces of land in Averham, to be used as public park or pleasure ground; includes covenants allowing (3) to make bye-laws for securing reasonable use of the park and the right to the production of deeds.

Schedule 1: description of the first parcel of land [details of bounding property provided].

Schedule 2: description of the second parcel of land [details of bounding properties provided]; reservation of coal and fishing rights.

Schedule 3: list of provisos to which the conveyance is subject.

Schedule 4: list of covenants on the part of (3), for example that the premises will not be used for anything other than a public park.

Schedule 5: list of deeds for production, beginning with Newcastle settlement of 29 Sep. 1885 and ending with conveyance of 5 Jan. 1934.

Includes a plan of the property in question; note that the land is on the banks of the River Trent and is now within the parish of Newark.

Recitals: (a) fact that at the date of (b) below, the 7th Duke of Newcastle under Lyne was seised of the property in question; (b) agreement dated 5 Apr. 1927 by which the duke sold the property to (2) but note that no conveyance was executed in pursuance of the agreement; (c) death of the 7th Duke in 1928 and appointment of trustees under his will; (d) death of one of the trustees in 1939; (e) fact that (2) wishes to give the property to (3) and that (1) have agreed to join in the conveyance.
