Gift from (1) to (2) of a piece of land containing 8,360 square yards on Tolney Lane, Averham [details of boundaries provided]; reserves to (1) all mineral rights, full and free passage and running of water and soil, rights relating to the River Trent and rights to erect buildings on adjoining land; covenants by (2) for the consruction and repair of fences, for maintenance of the land, not to erect any buildinhg inconsistent with the purposes of a park, to allow the inhabitants of Newark to use the land, only to use the land as a public park and so on; also includes covenant by (1) to pay the encumbrances on the property; acknowledgement by (1) of (2)'s right to the production of deeds listed in an appended schedule.
Recitals: (a) fact that (1) is seized of the property in question subject to a jointure rent charge of £3,000 and a term of 150 years for securing it, and also to a rent charge of £600 for pin money, contingent rent charges of £2,000 and £3,000 and a capital sum for portions of any children of the marriage of (1); (b) fact that (1) wishes to give the property in question for the purposes of a public park. |
