Content Description | First Party: Thomas Legh, esquire of Adlington, Cheshire.
Second Party: Lady Mary Bolles of Osberton, Nottinghamshire.
Agreed by and between parties that a marriage shall take place between Thomas Legh, son of (1) and Mary Bolles, daughter of (2).
Further agreed that (1) will convey all his manors, messuages, lands, tithes and so on, being both freehold and copyhold in the county of Chester to the following uses: the capital messuage known as 'the Milnhouse' with all lands, and several closes of named lands in Adlington, and all the tithes of corn and grain issuing from the capital messuage and its lands, and also tithes from the townships of Chelford, Snelson, Lower Withington, Sutton and Wincle in the parish of Prestbury [Cheshire]; property is to Thomas Legh and Mary Bolles for their maintenance and her jointure during the life of (1).
After the death of (1) the manor house called the 'Halle of Adlington' [Adlington Hall] and all lands with appurtenances [field names provided] and tithes of corn is to be conveyed to Mary Bolles for her jointure during the life of Anna, wife of (1); the capital messuage known as the Milnhouse with all lands and appurtenances is to the use of Mary Bolles for life as her jointure and the residue of the property is to the use of Anna; the property is agreed to be conveyed to Thomas Legh and Mary Bolles for their maintenance or her jointure in tail male; property (except the several jointures of Anna and Mary Booles) is to be charged with a yearly rent of £500 from the decease of (1) until the sum of £4000. has been reached or as directed by the will of (1).
Further agreed that in default of male issue of Thomas Legh and Mary Bolles, the property shall descend to any male issue of Thomas Legh by any woman he may marry after the death of Mary Bolles; property would then be chargable with the sum of £6000 for all and any daughters of Thomas Legh and Mary Bolles to be paid at £200 per annum until satisfied; payments to begin in the year in which the eldest daughter turns 18.
In consideration of the intended marriage, (2) covenants to pay (1) the sum of £3000, £1500 at the time of the celebration of the marriage and £1500 within one year; also (2) is to convey her messuage and lands in Clumber to the use of (2) for life and after her death to the use of Thomas Legh and Mary Bolles, and in default of issue to the rightful heirs of (2).
Further agreed that by the conveyances to be made by (1), there shall be full power and authority reserved to (1) to make any leases for any terms of three lives or 21 years, except for the capital messuage reserved for the maintenance or jointure of the marriage and other specified property and tithes.
(1) retains the right to demise or lease the tithes of corn, grain and hay issuing from several towns including Macclesfield, Bosley, Mottram St Andrew, Birtles, Henbury cum Pexhall, Newton, Pott Shrigley, Kettleshulme, Hurdsfield, Bollington and Poynton [all in Cheshire].
