Second Party: Lady Henrietta Cavendish Holles (only daughter and heiress of John, Duke of Newcastle, deceased).

Third Party: John, Earl Poulett, Lord Steward of HM Household; William, Viscount Cheyne of Newhaven; and Thomas, Lord Trevor, Lord Chief Justice of the Court of Common Pleas.

Covenant of (1) with (3) to convey (within 6 months of the marriage) real estate of the clear annual value of £1000 to the use of Lord Harley for life thence to (2) as her jointure, thence to the sons of the marriage successively in tail male, with remainder to Lord Harley and his heirs.

Covenant of (1) with (3) to convey (within 6 months of the marriage) all their other real estate in the Kingdom of England and Dominion of Wales (sic.), to the use of the Earl of Oxford for life, thence to Lord Harley for life, thence to the sons of the marriage successively in tail male, with remainder to Lord Harley and his heirs (subject to sums currently paid and not exceeding £200 p.a. for the augmentation of livings, and subject to the jointure of Sarah, Countess of Oxford and to provisions in the Earl of Oxford's settlement for raising portions for daughters).

Covenant of Lord Harley with (3) to join with (2) within 12 months of her reaching her majority in settling all her real estate upon trust: as to the purchases made by her late father (the Duke of Newcastle) at Arrington and Wimpole, Cambridgeshire and at Mary[le]bone in Middlesex, to trustees to be chosen by (2) in trust for her own separate use during the joint lives of Harley and (2); and thereafter, with all other premises purchased by the Duke since 29 Aug. 1707, to the use of Harley for life, thence to (2) for life, thence to the sons of the marriage successively in tail male, for want of which to such persons and uses as (2) shall appoint, with remainder to (2), her heirs and assigns;

And as to the residue of her property (except what was formerly the estate of her grandfather Henry, Duke of Newcastle): such portion as (2) and (3) shall think proper to trustees chosen by (2) in trust for her own separate use during the joint lives of Harley and (2) and in all other respects as for the property in Cambridgeshire (previous paragraph) and the balance upon the same trusts as the property purchased after 1707 as mentioned in the previous paragraph.

And as to the estate formerly belonging to Henry, Duke of Newcastle (except timber reserved to (2) during the life of the Duchess Dowager of Newcastle) to the use of Margaret, Duchess Dowager of Newcastle (mother of (2)) for life, with remainder to Harley for life, with remainder to (2) for life, with remainder to the sons of the marriage successively in tail male, for want of which to such person or persons taking the name of Cavendish as (2) shall appoint, with remainder to (2), her heirs and assigns.

Power to be reserved to (2) to appoint up to £3000 p.a. Leasing powers specified to be inserted in settlement. Provision throughout for trustees to preserve the contingent remainders. Subsidiary covenants by (1) and by Harley alone with (3) respecting the separate use of her property by (2).
