Content DescriptionFirst Party: The Governor, Bailiffs and Comonalty of the Company of Conservators of the Great Level of the Fenns called Bedford Level.

Second Party: William, Duke of Devonshire, guardian of Wriothesley, Duke of Bedford and Henry, Earl of Lincoln.

For securing the sum of £3,400 already laid out and the sum of £6,600 still to be laid out, and for enabling (2) to drain, secure and preserve the North Level by making a canal and other works, agreement between (1) and (2) that (2) may receive the taxes of the North Level, in proportions relating to the proportion of taxable land they hold; agreement that the taxes will be applied for repairing and maintaining all the works of the north level and for supporting other works which are required for the preservation of the same.

Recitals: (a) act of parliament dated 1663 [see Ne D 4532]; (b) fact that the Great Level is comprised of the North Level, the Middle Level and the South Level and that the North Level contains about 40,000 acres of land, of which 11,600 are subject to taxes; (c) fact that the Duke of Bedford is owner of around 19,500 acres of land in the North Level, of which 4,300 are subject to taxes and that the Earl of Lincoln is owner of 3,500 acres, all of which are subject to taxes; (d) fact that (2) have laid out £3,400 for keeping open outfall waters; (e) fact that as a result of floods and the insufficiency of the banks and works much of the land has recently been 'drowned' so that little or no profit can be made from it, that the north bank of the North Level needs to be enlarged and strengthened and that (1) have resolved to make a canal and complete other improvement works; (f) fact that (2) have agreed to advance the sum of £6,600 for the work; (g) fact that (1) have agreed that the taxes and rents arising out of the lands in the North Level shall be security for the total sum of £10,000 laid out by (2).
